Congressman Trey Gowdy (R-S.C.) questions Health and Human Services Secretary Kathleen Sebelius on the controversial HHS mandate. Secretary Sebelius displays a breathtaking lack of knowledge, and an equally stunning lack of humility, as she stumbles through this grilling.
She says that the mandate strikes the appropriate balance between religious freedom and women’s access to health care, yet knows nothing about the legal meaning of balance. She has no knowledge of the standard tests that lawyers use when determining balance on constitutional issues. She says that she based her decision on the mandate on legal advice, but denies that any department lawyer wrote a memo–she relied on a discussion with her legal experts.
Secretary Sebelius has not read any Supreme Court decisions on religious liberty. She is not familiar with Constitutional arguments about religious liberty. She is not familiar with recent Supreme Court decisions about religious liberty. She does not know the standard legal tests about constitutionality.
