Yesterday, Supreme Court Justice Sonia Sotomayor denied Hobby Lobby’s request for an emergency injunction against enforcement of the HHS mandate. On January 1st, Hobby Lobby will have to either comply with the mandate or face fines of up to $1.3 million per day.
Sotomayor ruled on the request because she is responsible for this sort of decision concerning cases before the 10th Circuit, which rejected Hobby Lobby’s request.
It is important to note that Sotomayor did not rule on the merits of the case and wrote that the plaintiffs may continue their appeals. She simply noted that it was not “Indisputably clear” that Hobby Lobby deserved for an injunction.
