Medical business denied injunction against HHS in district court

Annex Medical, Inc., was denied an injunction against the HHS in a ruling by a Minnesota district court this week.  Annex Medical is owned  by Stuart Lind, a Catholic dedicated to running his business in harmony with his faith.  Lind filed suit in November, seeking relief from the HHS mandate, because following the mandate would require him to violate his faith.

U.S. District Court Judge Doty ruled against Lind, mostly on the basis that he was not likely to win the case.  

It is interesting to note that Annex Medical had been paying for contraceptive coverage for employees, unintentionally and unknowingly, and the judge considered this evidence that further such payment would not cause the plaintiff harm.  This is exactly the opposite of the reasoning of the 7th Circuit Court of Appeals in the Korte & Luitjohan case.
