Victory for conscience rights in New York

At Mt Sinai Hospital in New York, Nurse Cathy Cenzon-DeCarlo was forced to participate in an abortion, despite clearly stating that her Catholic beliefs forbade such a participation.  The hospital, in 2009, ordered Cenzon-DeCarlo to assist with the abortion on short notice, threatening disciplinary action should she refuse.  

Alliance Defending Freedom attorneys filed suit on behalf of Cenzon-DeCarlo and requested that the Office of Civil Rights of the Department of HHS investigate.  ADF attorneys allege that the hospital was violating New York state conscience protection laws. 

As a result, Mt Sinai Hospital has changed its policy.  The new policy reads:

It is the legal right of any individual to refuse to participate in these procedures.

Mt Sinai Hospital also agreed to abide by federal conscience protection laws, train employees about the laws, and not discriminate against employees based on their objection. 

Thanks to the courage of Nurse Cenzon-DeCarlo, and the attorneys at ADF for standing up to intimidation and forcing the Mt Sinai Hospital to obey the law.
